A prenuptial agreement ("prenup" or premarital agreement) may be a useful tool to protect individuals entering into a marriage. The contract provides for a future division of assets or other arrangements in the case of divorce. Specifically, prenuptial agreements may be appropriate for couples who marry at a later age after acquiring considerable assets, have children or expect to inherit family wealth.

In preparing prenuptial agreements, the law requires that both parties:

• have ample time to review the prenuptial document
• have the opportunity to consult with independent counsel
• make a full disclosure of assets
